Miceli's House bill to reinstate the death penalty, 7/9/09 Representative James Micelli (19th Middlesex) has filed a bill in the House of Representatives to reinstate the death penalty in Massachusetts. A copy of the bill is attached. The bill would make death a possible punishment for numerous types of killings, including the murder of police officers, firefighters, corrections officers, judges, jurors, witnesses, prosecutors, and the governor or other elected state officials, killings by prisoners, killings by previously convicted murderers, murders involving torture, killings using a bomb, machine gun or automatic weapon, killings involving the risk of death to another person, and murders committed as acts of political terrorism. The bill also includes features prominent in the bill previously filed by Governor Romney – the need for some type of type of scientific evidence (broadly defined) to prove guilt and a panel of experts who would evaluate the use of scientific evidence after a death sentence is imposed. The bill was late filed, and thus what will happen to it is uncertain. MCADP will keep you informed. Meanwhile, you can remind your legislator of your opposition to the death penalty. The MCADP website has a list of the co-sponsors of the bill. [link here] Of particular concern are Representatives Arciero and Dwyer, who are new legislators who have not yet voted on a death penalty bill and Representatives Atsalis, Fallon, and Petersen, who voted against the death penalty in 2007. It would be helpful if voters in their districts let them know of their opposition to Micelli’s bill.
